Admission of revision contingent on adequacy of reasoning regarding expectation of out-of-court settlement in compensation claim.
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) granted admission of the plaintiff's non-admission complaint, permitting an appeal to the BGH regarding the upper-level court's decision on specific claims totaling €20,998.57 plus interest and a third category of claims, while simultaneously rejecting the complaint as inadmissible for the fourth category of claims due to insufficient reasoning that failed to address the appellate court's decisive justification. The dispute arises from civil litigation where the plaintiff challenged a lower court’s ruling, specifically contesting the denial of their entitlement to claim-based relief, which hinged on whether they could reasonably expect out-of-court settlement without engaging judicial assistance. The procedural outcome is governed by the admissibility standards of § 552 Abs. 1 Satz 2 ZPO, which requires the complaint to demonstrate a substantial legal interest or fundamental error, and the decision reflects the application of this threshold to selectively admit the appeal only where the appellant adequately engaged with the appellate court’s substantive logic.

BGH, Beschluss vom 17. Dezember 2020 - I ZR 88/20, juris Rn. 18 mwN).
