Admission of revision on product liability delicts due to fundamental significance of vehicle circulation law
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) admitted the revision appeal filed by the plaintiff solely with respect to the appellate court's dismissal of the claims regarding delictious damage caused by the introduction of a specific vehicle into traffic, leaving those portions of the lower court's judgment open for further review, while rejecting the remainder of the non-admission complaint as lacking fundamental significance. The dispute concerned a product liability claim where the plaintiff sought compensation for damage allegedly resulting from the defective or unsafe nature of a vehicle placed in circulation by the defendant. The decisive legal basis involved the requirements for admitting revision under the German Code of Civil Procedure (ZPO), specifically examining whether the case presented a question of fundamental legal significance or necessitated the unification of jurisprudence, alongside a review of procedural fundamental rights which the appellate court did not successfully violate.
