Inadmissibility of revision for engine manufacturer liability in emission scandal based on insufficient pleading of tortious competition and procedural fundamental rights
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-acceptance of revision, thereby upholding the Lower Regional Court's (OLG) decision to refuse leave for appeal; consequently, the lower court's judgments rejecting the plaintiff's claims remain in force. The dispute concerned a tort claim arising from an alleged emission scandal, where the plaintiff sought damages from an engine manufacturer, alleging liability for intentional legal violations by vehicle manufacturers. The BGH found no ground for granting the revision, ruling that the plaintiff failed to demonstrate the decision-relevance of the claimed admissibility grounds regarding a claim under § 823(2) BGB in conjunction with the EU General Food Law (specifically §§ 6(1), 27(1) EG-FGV) or a claim under §§ 826, 31 BGB, and concluded that alleged violations of procedural fundamental rights were not substantiated. The plaintiff was ordered to bear the costs of the appellate proceedings, with the value in dispute capped at 25,000 euros.
