Admissibility of non-admission complaint based on fundamental significance of Article 3 No. 10 Regulation (EC) No. 715/2007
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of appeal, leaving the appellate court's decision final and placing the costs of the proceedings on the plaintiff, who therefore did not prevail. The dispute concerned a non-appealable order issued by a Higher Regional Court in a civil matter, where the plaintiff sought to establish that the case had fundamental legal significance or required revision to ensure uniform jurisprudence. The court ruled that the plaintiff failed to sufficiently demonstrate the decisional relevance of the legal questions raised under Article 3 No. 10 of Regulation (EC) No. 715/2007, citing §§ 543(2) Sentence 1 No. 1 and 544(6) Sentence 2 of the Code of Civil Procedure (ZPO) as the decisive legal basis for refusing to hear the case on the merits.
