Leave-to-appeal review of procedural error in conditional auxiliary claims under § 308(1), § 528(2) ZPO and scope of tortious liability for pre-trial costs
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint for leave to appeal, upholding the Kammergericht's earlier order and leaving the lower court's judgment in force. The dispute concerned a claim for payment of legal costs arising from the pre-trial phase and a conditional claim for damages related to the put-into-circulation of a vehicle, where the appellate court had previously dismissed the main declaratory claim as inadmissible and subsequently rejected the conditional auxiliary claim. The BGH held that the case lacked fundamental legal significance because the appellate court had procedurally erred by failing to recognize that the condition for the auxiliary claim had not been met, which would have required the automatic reversal of that specific part of the judgment under §§ 308(1), 528(2) ZPO, a procedural point the plaintiff failed to properly invoke as a ground for admissibility; furthermore, the claim for pre-trial legal costs could not be reviewed on appeal because the underlying tortious liability was already conclusively settled between the parties. The court based its decision on §§ 543(2), 544(6), and 97(1) ZPO, noting that the matter did not require the Supreme Court's intervention to ensure uniform jurisprudence or legal development.
