Denial of revision admissibility for tort claims against motor manufacturer under §§ 826, 31 BGB and EU vehicle regulations
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the plaintiff's non-acceptance complaint, thereby upholding the appellate court's decision and affirming the defendant's victory. The dispute concerned claims for damages under German civil law, specifically alleging intentional tortious conduct and violations of European Union motor vehicle regulations. The court held that the plaintiff failed to demonstrate that the case possessed fundamental significance or that legal development or uniformity of case law required a revision ruling. Decisively, the court found the plaintiff had not adequately substantiated a claim under §§ 826, 31 BGB against the defendant, as the latter was identified as a motor manufacturer rather than a vehicle manufacturer, and the alleged intentional violation of law by the vehicle manufacturer was insufficiently proven. Additionally, the claimed violations of procedural fundamental rights were deemed non-successful, leaving the appellate judgment in force with the plaintiff bearing the costs of the complaint proceedings.
