Denial of legal aid for declaratory relief on third-party rights in post-mortem guardianship proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the application by the son of a former care recipient for the appointment of a legal aid counsel, ruling that the intended legal proceedings were hopeless. The dispute arose in the context of a guardianship proceeding where the applicant, as a further participant, sought to file a declaratory action under § 62 FamFG within the appeal procedure following the death of the care recipient to challenge interference with his rights. The court held that such declaratory actions under § 62 FamFG are limited to interventions concerning the rights of the care recipient itself, not those of other participants in the proceedings, and cannot be filed by a party with standing under § 303 Abs. 2 FamFG in the interest of the deceased recipient or by a former power of attorney holder on the deceased's behalf. The decision relied on § 10 Abs. 4 Satz 3 FamFG in conjunction with § 78 b ZPO, which denies legal aid when the prospects of success are negligible.
