Statute of limitations: Determination of claim accrual date under §§ 199, 200 BGB versus set-off rules
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's complaint against the non-admission of revision, thereby rejecting the defendant's attempt to further appeal and leaving the lower appellate court’s decision on the merits in force. The dispute concerned a civil claim where the defendant challenged the timing of the statute of limitations, specifically arguing for a different point of accrual based on a prior Senate judgment regarding set-off. The court held that the case raised no questions of fundamental legal significance and was not necessary for the development of law, relying on the doctrine that a claim arises for limitation purposes under §§ 199, 200 BGB only when it becomes enforceable by action (due), a principle the cited 2006 judgment did not alter as it applied to former § 390 Sentence 2 BGB. The defendant was ordered to bear the costs of the complaint proceedings.

[GRUENDE]
Aufl., § 199 Rn. 3). Von einer weiteren Begründung wird abgesehen (§ 544 Abs. 6 Satz 2 ZPO).
