Legislator-Zusammenfassung

The Federal Court of Justice’s 8th Civil Senate rejected the complainant’s objection to the assessment of court fees, leaving the initial order for the party to pay 532 euros in legal costs in force. The dispute arose after the court had previously dismissed the party’s complaint against the non-admission of a revision appeal in a civil matter, setting the value in dispute at 9,600 euros and subsequently issuing an invoice for the corresponding 2.0 fee. The complainant challenged the validity of the entire underlying procedure rather than the specific calculation or legal basis of the fee assessment. The court held that an objection under § 66(1) German Courts and Fees Act is limited to errors in the fee calculation or violation of cost law, and does not allow the re-examination of the substantive legality of the proceedings; because the fee was correctly calculated based on the specified value in dispute, the objection lacked merit.

Die Erinnerung des Beschwerdeführers vom 10. Mai 2023 gegen den Kostenansatz des Bundesgerichtshofs vom 12. Oktober 2022 (Kassenzeichen 780022144430) wird zurückgewiesen.

[GRUENDE]

I. Mit Beschluss vom 27.

3. Das Erinnerungsverfahren ist gerichtsgebührenfrei. Außergerichtliche Kosten werden nicht erstattet (§ 66 Abs. 8 GKG).
