Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the debtor’s legal remedies as inadmissible, resulting in the appellate court’s decision of January 3, 2023, remaining in force, with costs awarded to the opposing party. The case involved a challenge in a compulsory enforcement proceeding where the debtor filed both an ordinary legal complaint and a complaint regarding the refusal to admit the legal complaint against a decision by the regional court. The decisive legal basis is § 574(1) sentence 1 no. 2 ZPO, which renders the legal complaint inadmissible without express admission by the appellate court; the court held that the refusal to admit such a complaint is not subject to judicial review via a separate complaint or otherwise required by constitutional law.

Die Rechtsmittel vom 27. Februar 2023 und vom 8. Mai 2023 gegen den Beschluss des Landgerichts Heilbronn- 1. Zivilkammer - vom 3.

BGH, Beschluss vom 23. September 2020 - I ZB 60/20, juris Rn. 2 mwN). BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133 [juris Rn. 7 f.]; Beschluss vom 19. Mai 2022 - I ZB 26/22, juris Rn. 3).

2. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
