Cost allocation and dispute value assessment following withdrawal of a legal review in energy regulation proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Cartel Court (Kartellsenat of the BGH) ordered the appellant to bear the costs of the legal review proceedings, including the necessary expenses of the regulatory authority, while denying reimbursement for other participants and setting the value in dispute at €500,000. The case involved a legal review (Rechtsbeschwerde) in an energy regulation matter that was initiated by the appellant but subsequently withdrawn. The court applied the procedural rule that a party withdrawing an appeal assumes the status of the losing party, thereby incurring the costs of the procedure under § 90 EnWG and the principle of equity; the refusal to reimburse other parties' expenses was justified by the withdrawal, and the value in dispute was fixed under § 50 GKG with no reduction permitted under § 40 GKG.

Eine weitergehende Kostenerstattung findet nicht statt.

[GRUENDE]
