The German Federal Court of Civil Procedure (BGH) rejected the defendant's opposition (Gegenvorstellung) to the Fourth Senate's earlier order, thereby denying the defendant's application for litigation cost assistance; consequently, the defendant did not prevail in securing funding for the defense of the tenant's action. The case involved a tenancy dispute where the defendant tenant challenged a modernization rent increase, arguing financial hardship, while the plaintiff landlord pursued the claim. The court held that the defendant's filing constituted a mere opposition rather than an immediate appeal, as no such remedy exists against appellate decisions under § 567 para. 1 and § 127 para. 2 sentence 1 ZPO. Regarding cost assistance, the court determined the relevant net rent for calculating the "Beschwer" (amount in controversy) was €345, resulting in a dispute value of €14,490, based on the tenant's own statements, and excluded the increased rent from the calculation because the tenant had already successfully asserted the defense of financial hardship against the modernization notice and refused to pay the higher amount.
