Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the debtor's legal appeal (Rechtsbeschwerde) as inadmissible, leaving the decision of the Munich Higher Regional Court in force. The dispute concerned the debtor’s attempt to challenge the rejection of a judge’s recusal request (Ablehnungsgesuch). The BGH held that the appeal was inadmissible for two independent reasons: first, the statute does not expressly permit a Rechtsbeschwerde against the dismissal of a recusal motion, and the lower court had not granted leave for such an appeal; second, the appeal was not filed by a lawyer admitted to practice before the BGH. Consequently, the debtor bore the costs of the proceedings.

Die Rechtsbeschwerde der Schuldnerin gegen den Beschluss des Oberlandesgerichts München - 36. Zivilsenat - vom 27.

April 2023 - I ZB 19/23, juris Rn. 2 mwN).

II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
