Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the applicant's objection regarding the alleged violation of the right to be heard (*Anhörungsrüge*) as inadmissible, leaving the lower court's ruling of February 22, 2023, in force and ordering the applicant to bear the costs. The dispute centered on a procedural challenge in the legal complaint (*Rechtsbeschwerde*) proceedings, where the applicant, who was not represented by a lawyer admitted to the Federal Court of Justice, sought to overturn the court's earlier decision. The court ruled that the objection was inadmissible because the statutory obligation of mandatory legal representation (*Anwaltszwang*) under § 78 para. 1 sentence 3 ZPO applies to all submissions, including objections to the right to be heard, made within the appellate legal complaint procedure, and analogously applied § 97 para. 1 ZPO for the cost allocation.

Volltext

Juli 2021 - I ZB 28/21, juris Rn. 2 mwN).

II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO analog.

III.
