Non-allowance of appeal in contract dispute: failure to demonstrate fundamental significance or need for legal development on damage causation under § 543 Abs. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-allowance of appeal, upholding the decision of the Hamm Higher Regional Court and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil claim where the lower court based its judgment on issues of damage causation; the plaintiff failed to demonstrate that the case involved questions of fundamental legal significance or required the development of law or uniform jurisprudence. The Court held that the appellate decision was independently sustainable on the merits of damage causation, thereby finding no substantial grounds for allowing revision under § 543(2) No. 1 and 2 ZPO in conjunction with Art. 267 TFEU, and further determined that alleged violations of procedural fundamental rights were not substantiated.
