The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-acceptance, thereby upholding the decision of the Higher Regional Court of Hamm that had previously rejected the plaintiff's appeal. The dispute concerned the right of withdrawal in consumer credit agreements for two real estate loans secured by mortgages: one loan exceeding €75,000 and the other classified as a subsidized loan. The court held that the appeal lacked fundamental legal significance and did not require revision to ensure uniform jurisprudence. Legally, the court determined that the EU Consumer Credit Directive (2008/48/EC) did not apply to these specific contracts due to exclusions under Article 2(2)(a), (c), and (l), and it found that the European Court of Justice's ruling in the *Volkswagen Bank* case was not applicable to the facts at hand. Consequently, the prior lower court rulings remain in force, and the plaintiff was ordered to bear the costs of the proceedings.

Verbraucherkreditvertrag: Widerruf grundpfandrechtlich abgesicherter Immobiliardarlehensverträge

[TENOR]

März 2019 - XI ZR 44/18, WM 2019, 864 Rn. 17; EuGH, Urteil vom 26.
