Tort liability for unlawful act based on avoidable prohibition error in window installation.
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-admission complaint, thereby upholding the lower appellate court's decision that denied leave to appeal. The dispute concerned a tort claim based on the unlawful installation of a thermowindow, where the appellate court had found no actionable tort because the defendant acted under an unavoidable prohibition error, thus relying on its own independent legal assessment rather than the trial court's reasoning. The supreme court held that the complaint failed to demonstrate a fundamental legal question or a need for legal development under German civil procedure law, and dismissed the claimed violations of procedural fundamental rights as unsubstantiated, ordering the plaintiff to bear the costs of the proceedings.
