Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the plaintiff's complaint against the non-acceptance of revision, leaving the appellate court's judgment in favor of the defendant fully in force. The dispute concerned a tort claim under § 823 (2) German Civil Code, asserting a violation of the EU Food and Feed Regulation and associated Union law provisions regarding food safety obligations. The appellate court had rejected the claim on the ground that the defendant had acted under an unavoidable prohibition error, thereby lacking the requisite fault for an unlawful act. The Federal Court of Justice held that the case did not possess fundamental significance, nor did it require further legal development or the securing of uniform jurisprudence, and found no compelling violations of procedural fundamental rights, thereby refusing to grant the plaintiff's request for a hearing at the revision level.
