Inadmissibility of legal complaint against enforcement court order lacking statutory leave to appeal
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (1st Civil Division) dismissed the debtor's legal complaint (Rechtsbeschwerde) as inadmissible, assigning costs to the debtor and rejecting the application for the appointment of a duty lawyer. The dispute arose in a compulsory enforcement proceeding where the debtor challenged a decision issued by the Landgericht Augsburg. The court ruled that the legal complaint was not permissible because the lower appellate court had not granted the statutory leave required for such filings in enforcement matters, and the decision not to grant leave is not subject to further ordinary or extraordinary appellate review. Consequently, the request for a legal aid lawyer was denied as the proceedings were futile under § 78b ZPO due to the procedural inadmissibility based on §§ 574 and 577 ZPO.

Die Rechtsbeschwerde gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 14.
BGH, Beschluss vom 4. Januar 2023 - I ZB 88/22, juris Rn. 2 mwN).
II.
III. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
