Admissibility of revision based on food safety regulation breach under tort law
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of a revision appeal, thereby upholding the appellate court's decision in a civil tort case. The dispute concerned a claim for damages based on an intentional tort under § 823 Abs. 2 BGB in connection with food safety regulations, specifically § 6 Abs. 1 and § 27 Abs. 1 of the EG-FGV or Art. 5 of Regulation (EC) No. 715/2007. The appellate court had rejected the claim on the grounds that there was no culpable unlawful act by the defendant. The BGH found no grounds for fundamental legal significance or legal development to justify a revision, noting that the arguments failed to demonstrate a violation of procedural rights, and ordered the plaintiff to bear the costs of the proceedings, with a subject matter value up to €35,000.
