Inadmissibility of hearing objection for lack of mandatory attorney representation in insolvency legal complaint proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed a debtor's hearing objection (Anhörungsrüge) as inadmissible and awarded costs to the court, ruling in favor of the court's prior procedural order. The dispute arose in insolvency proceedings where the debtor, represented by non-counsel, filed an objection against a prior BGH decision dated March 6, 2023, alleging a violation of the right to be heard. The court held that the objection was procedurally defective because the debtor failed to submit it through a legal advocate admitted to practice before the BGH, as mandatory attorney representation (Anwaltszwang) applies to all filings in the legal complaint procedure, including hearing objections. The decisive legal basis was § 78 Abs. 1 Satz 3 ZPO, which mandates counsel for legal complaints, and § 321a Abs. 1 ZPO regarding the admissibility of hearing objections, resulting in the rejection of the filing and the application of § 97 Abs. 1 ZPO for cost allocation.

April 2022 - I ZB 3/22, juris Rn. 1 mwN).
4. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO analog.
