Insurance policy EU directive compliance: no preliminary reference where consumer was properly informed
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-allowance of revision, thereby upholding the lower court's decision and ordering the plaintiff to bear the costs of the proceedings. The dispute, concerning an insurance policy and a dispute value of €60,461.54, centered on a challenge to the non-allowance of a further appeal to the BGH. The court held that the case lacked fundamental legal significance and did not require the further development of law or the assurance of uniform jurisprudence pursuant to § 543(2) No. 1 ZPO, specifically noting that the question of the policy model's compliance with EU directives was not decisive for the outcome and that a preliminary reference to the European Court of Justice was unnecessary because the relevant ECJ ruling addressed scenarios involving improperly informed consumers, which were not present in this instance.

Februar 2023 - IV ZR 353/21, juris).
Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
