Legislator-Zusammenfassung

KI-generiert

The Federal Court of Civil Procedure (BGH) ordered the plaintiff to bear the costs of the revision instance and declared the revision futile following its withdrawal, thereby leaving the judgment of the Munich Higher Regional Court of 28 July 2022 in force; a concurrently filed application for leave to appeal on points of law was dismissed as moot. The dispute, involving a principal amount of up to €7,000, concerned a civil matter where the appellate court had decided only on the main applications and granted unrestricted leave for revision, rendering the precautionary legal complaint against non-admission of the revision procedurally superfluous. The decisive legal basis for the cost allocation and the procedural status of the withdrawn revision was § 565 Sentence 1 in conjunction with § 516 Paragraph 3 of the German Code of Civil Procedure (ZPO), which mandates that the party withdrawing a revisionary appeal bears the costs if the appeal is declared futile.

Volltext

BGH, Urteil vom 22. November 2016 - XI ZR 434/15, BGHZ 213, 52 Rn. 5 f.; Urteil vom 21. Februar 2022 - VIa ZR 8/21 BGHZ 233, 16 Rn. 17 ff.).

Die Kosten der Revision werden dem Kläger auferlegt (§ 565 Satz 1, § 516 Abs. 3 ZPO).
