Inadmissibility of legal appeal against enforcement decision due to lack of statutory permission
Legislator-Zusammenfassung
KI-generiertThe BGH 1st Civil Senate dismissed the legal appeal as inadmissible, leaving the prior decision in force, with costs charged to the debtor. The dispute concerned a decision issued by the Landgericht Augsburg within a compulsory enforcement proceeding, where the debtor attempted to challenge the lower court's ruling. The appeal was rejected because the legal appeal is not admissible against enforcement decisions unless the appellate court has explicitly granted leave to appeal, which it did not do; the refusal to grant leave is itself not subject to review, and no extraordinary or constitutional remedy was available. The decisive legal basis for the dismissal was § 574 Abs. 1 S. 1 Nr. 1 and 2 ZPO regarding the inadmissibility of legal appeals in enforcement matters without permission, and § 577 Abs. 1 ZPO for the dismissal of the unstatutory appeal.

Die Rechtsbeschwerde gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 12.
BGH, Beschluss vom 23. März 2021 - I ZB 5/21, juris Rn. 2). BGH, Beschluss vom 9. Dezember 2021 - I ZB 57/21, juris Rn. 2 mwN). BGH, Beschluss vom 22. Juni 2021 - I ZB 28/21, juris Rn. 2 mwN).
II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
