Inadmissibility of legal appeal against judicial recusal order without express grant by appellate court
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the debtor's legal appeal (Rechtsbeschwerde) as inadmissible, leaving the Landgericht Augsburg's decision of October 26, 2021, in force, with costs borne by the debtor. The dispute concerned the admissibility of an appeal against a lower court's order in a judicial recusal proceeding (Richterablehnung), specifically whether the appellate court was required to grant permission for the highest instance review. The court held that a legal appeal in such proceedings is only permissible if explicitly granted by the appellate court under Section 574 (1) Sentence 1 No. 2 of the Code of Civil Procedure (ZPO); since no such grant occurred, the appeal was statutorily barred, and the denial of permission is not itself subject to further appeal or constitutional review, resulting in the dismissal under Section 577 (1) ZPO.

Die Rechtsbeschwerde gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 26.
BGH, Beschluss vom 18. Januar 2018 - I ZB 101/17, juris Rn. 4). BGH, Beschluss vom 9. Dezember 2021 - I ZB 57/21, juris Rn. 2 mwN). BGH, Beschluss vom 22. Juni 2021 - I ZB 28/21, juris Rn. 2 mwN).
II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
