Inadmissibility of legal appeal in compulsory enforcement proceedings absent express permission by the appeal court under § 574 Abs. 1 S. 1 Nr. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's legal appeal as inadmissible, leaving the lower court's enforcement decision in force and ordering the debtor to bear the costs. The dispute concerned a motion for legal appeal against an appeal court ruling issued in a compulsory enforcement proceeding, where the debtor challenged the validity of the appellate outcome. The court held that under Section 574(1) Sentence 1 No. 2 ZPO, a legal appeal against such enforcement rulings is permissible only if the appeal court expressly permits it; since no such permission was granted, the appeal was not admissible and was rejected pursuant to Section 577(1) ZPO.

Die Rechtsbeschwerde gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 4.
BGH, Beschluss vom 23. März 2021 - I ZB 5/21, juris Rn. 2). BGH, Beschluss vom 9. Dezember 2021 - I ZB 57/21, juris Rn. 2 mwN). BGH, Beschluss vom 22. Juni 2021 - I ZB 28/21, juris Rn. 2 mwN).
II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
