Confiscation of drug-trafficking proceeds: exclusion of unpaid purchase balance due to nullity of illegal contract and failure to substantiate receipt
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice partially upheld the defendant’s revision, vacating the sentencing portions of the Landgericht Frankenthal’s judgment to permit a subsequent judicial decision on the aggregate sentences pursuant to §§ 460, 462 StPO, while simultaneously amending the confiscation order to reduce the value of criminal proceeds subject to seizure to €1,195; the remainder of the revision was dismissed and costs imposed on the defendant. The dispute concerned a revision challenging the calculation of aggregate sentences and the extent of confiscation for drug trafficking offenses, specifically the inclusion of an alleged €300 remainder payment for a kilogram of amphetamines in the total proceeds. The Court held that the lower court failed to substantiate the receipt of the additional €300 and that, due to the legal nullity of the illegal drug sale contract, the defendant could not have acquired a valid claim for the unpaid balance, thus excluding it from the confiscable criminal proceeds.

Volltext
BGH, Urteil vom 15. April 2021 - 5 StR 371/20 Rn. 17 mwN).
