Streitwertfestsetzung für das Verfahren der Nichtzulassungsbeschwerde: Werterhöhung durch Zinsforderungen

[TENOR]

Die Beschwer des Klägers und der Streitwert für das Verfahren über die Nichtzulassungsbeschwerde werden auf 21.553,97 € festgesetzt.

[GRUENDE]

I. Der Kläger verlangt von der Beklagten Schadensersatz. Er wirft ihr vor, sie habe in den Dieselmotor EA 189 eines von ihm am 29. Mai 2013 zum Preis von 32.430 € erworbenen Fahrzeugs (Audi Q 3) eine verbotene Abschalteinrichtung eingebaut.

Nachdem der Kläger das Fahrzeug für 14.200 € weiterveräußert hatte, hat er zuletzt beantragt, die Beklagte zur Rückzahlung des Kaufpreises Zug um Zug gegen Herausgabe des Verkaufserlöses, Zahlung von Zinsen in Höhe von 4 % aus 32.430 € seit dem 29. Mai 2013 bis Rechtshängigkeit und Erstattung außergerichtlicher Rechtsanwaltskosten zu verurteilen. Das Berufungsgericht hat die Klageabweisung durch das Landgericht bestätigt und den Streitwert auf 18.230 € festgesetzt. Mit der Revision, deren Zulassung der Kläger begehrt, möchte er sein Begehren in vollem Umfang weiterverfolgen.

II. Die mit der beabsichtigten Revision geltend gemachte Beschwer sowie der Streitwert für das Verfahren der Nichtzulassungsbeschwerde betragen 21.553,97 € (18.230 € + 3.323,97 €).

Bei der Bemessung des Werts des Antrags auf Rückzahlung des Kaufpreises (32.430 €) ist hierauf der Erlös aus der Weiterveräußerung des Fahrzeugs (14.200 €) anzurechnen (vgl. BGH, Beschluss vom 19. Mai 2021 - VII ZR 216/20, juris Rn. 4). Streitwert und Beschwer betragen daher insoweit 18.230 €.

Die vom Kläger erhobenen Zinsforderungen wirken gemäß § 4 ZPO insoweit streitwerterhöhend, als sie nicht neben der Hauptforderung geltend gemacht werden (vgl. Senat, Beschluss vom 4. September 2013 - III ZR 191/12, juris Rn. 2), also in Höhe von 4 % aus 14.200 € seit dem 29. Mai 2013 bis zum Eintritt der Rechtshängigkeit am 4. April 2019 (vgl. LGU 5). Dies ergibt einen Betrag in Höhe von 3.323,97 €.
