Consumer Loan Withdrawal in Pre-2010 Contracts: Temporal Scope of Directive 2008/48/EG and Good Faith Bar Under § 242 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff-consumers' complaint for non-acceptance of leave to appeal, upholding the lower appellate court's decision that their right to withdraw from a consumer loan contract is barred by good faith (§ 242 BGB). The dispute concerned whether the temporal scope of Directive 2008/48/EC applied to a loan agreement concluded before June 11, 2010, and whether the borrowers' late exercise of the withdrawal right constituted an impermissible exercise of rights (verwirkung). The court determined that the European Directive does not apply to contracts predating the specified cutoff date, leaving the assessment of good faith violations solely to national law; consequently, the BGH found no grounds to accept the revision, as the appellate court's ruling aligns with established BGH principles regarding the unpermitted exercise of rights.

Widerruf eines Verbraucherdarlehensvertrags in einem Altfall: Zeitlicher Anwendungsbereich der Verbraucherkreditrichtlinie; Verstoß gegen Treu und Glauben
[TENOR]
