Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the plaintiff's complaint for leave to appeal, upholding the lower court's decision and leaving the original judgment in force; the plaintiff is ordered to bear the costs of the complaint proceedings. The dispute concerned a mortgage-secured real estate loan exceeding €100,000, where the plaintiff argued that the case involved a question of fundamental significance regarding the applicability of the Consumer Credit Directive. The court held that no such significance existed because Article 2(2)(a) and (c) of Directive 2008/48/EC explicitly excludes mortgage credit agreements secured by an interest in real property from its scope, rendering recent European Court of Justice jurisprudence on consumer credit inapplicable. Consequently, the court found no need to address the matter of legal development or uniform interpretation, relying on its prior consistent rulings that such high-value, mortgage-secured loans fall outside the protective framework of the Consumer Credit Directive.

Grundpfandrechtlich besicherter Immobiliardarlehensvertrag: Einschlägigkeit der Rechtsprechung zur Verbraucherkredit-Richtlinie

[TENOR]

März 2019 - XI ZR 44/18, WM 2019, 864 Rn. 17; EuGH, Urteil vom 26. September 2021 (C-33/20 u.a., juris - Volkswagen Bank u.a.) nicht einschlägig.
