The Federal Court of Justice (BGH) dismissed the defendant's revision, upholding the Landgericht Dresden's sentencing judgment and the confiscation order for 113,500 euros, thereby ruling in favor of the prosecution. The dispute centered on the correct legal basis for confiscating the value of book funds obtained through money laundering offenses, where the defendant challenged the lower court's application of compulsory confiscation provisions. Although the appellate court noted that the Landgericht erred in legal classification by applying §§ 73, 73c StGB (compulsory confiscation) instead of the applicable § 261 Abs. 7 StGB in conjunction with §§ 74 Abs. 2, 74c StGB (discretionary value-surrogate confiscation) under the law in force at the time of the offense, this error did not render the decision unlawful under § 337 Abs. 1 StGB. The BGH determined that the amended provisions of §§ 73 ff. StGB introduced by the 2021 money laundering package are not "milder law" under § 2 StGB because they mandate compulsory confiscation rather than discretionary, and thus the Landgericht was required to apply the old law; consequently, a discretionary value-surrogate confiscation would have been permissible and the court excluded that the outcome would have differed under the correct legal standard.
