The German Federal Court of Civil Procedure (BGH), 11th Civil Senate, rejected the plaintiffs' objection to the denial of justice (Anhörungsrüge) at their own expense, upholding the court's prior dismissal of their appeal. The dispute concerned a civil matter where the plaintiffs alleged that the Senate had violated their constitutional right to be heard by overlooking their substantive arguments in a preceding decision dated March 30, 2021. The court ruled that the right to be heard was not violated in a manner relevant to the decision, finding that the challenged submissions had been reviewed and deemed insufficient, and relied on the discretionary power under Section 544 Paragraph 6 Sentence 2 Half-sentence 2 of the Code of Civil Procedure (ZPO) to omit a detailed legal justification, citing corresponding application of Section 321a Paragraph 4 Sentence 5 ZPO.

Volltext

August 2017 - XI ZR 200/17, juris Rn. 3, vom 25. April 2018 - XI ZR 589/17, juris Rn. 2 und vom 13. Januar 2021 - XI ZR 246/19, juris, jeweils mwN).
