Leap appeal admissibility absent party consent and fundamental legal significance: denial of legal aid under § 566 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 11th Civil Senate rejected the defendant's application for legal aid to file a leap appeal (Sprungrevision) against a district court judgment, thereby leaving the first-instance decision in force as the defendant failed to meet the statutory admissibility requirements. The dispute concerned a civil litigation where the defendant attempted to bypass the appellate instance directly to the supreme court without the plaintiff's consent, challenging the lower court's ruling. The court determined the leap appeal was not permissible because the requisite consent of the opposing party under Section 566(1) sentence 1 No. 1 of the Code of Civil Procedure (ZPO) was absent, and the case lacked the necessary fundamental legal significance or need for uniform case law under Section 566(4) sentence 1 ZPO to warrant such an exception.

2 ZPO abgesehen.
