Liability for pipeline operation under the Liability Act and sales law: non-admission of appeal in revision for lack of fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of an appeal in revision, ruling that the plaintiff bears the costs of the proceedings; consequently, the lower court's decision remains in force. The dispute concerned a claim against a defendant, challenging liability based on both sales law and the operation of a pipeline system under the Liability Act. The Court determined that the case lacked fundamental legal significance, and there was no need for legal development or uniform case law, noting that the specialized Civil Senate responsible for water law agreed with this assessment regarding the operational liability aspect.
