The German Federal Court of Criminal Sixth Senate dismissed the defendant's appeal and her immediate complaint against the cost allocation, leaving the lower court's judgment in force and ordering the defendant to bear the costs of the proceedings, special costs arising from the adhesion proceedings, and necessary expenses of the ancillary and adhesion plaintiffs. The case involved a challenge to the initial criminal conviction and, specifically, the Landgericht Bamberg's decision to impose the full necessary expenses of the adhesion plaintiffs on the defendant despite the court having abstained from deciding on significant parts of the adhesion claims under § 406 Abs. 1 Satz 3 StPO. The appellate court ruled that the cost order was a valid exercise of discretion (§ 472a Abs. 2 Satz 1 StPO) under the special circumstances, applying the legal principle of § 92 Abs. 2 Nr. 2 Fall 1 ZPO, and the dismissal followed from §§ 349 Abs. 2 and 473 Abs. 1 StPO.
