Denial of legal aid for non-admission complaint due to manifest lack of prospects
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's application for the appointment of a statutory lawyer (Notanwalt) for a proposed non-admission complaint (Nichtzulassungsbeschwerde). The dispute arose from the defendant's intent to challenge the lower court's order refusing to admit a revision appeal, necessitating the appointment of a lawyer qualified to practice before the BGH. The court ruled that the application failed because the intended legal recourse was deemed hopeless (aussichtslos), as no grounds for admitting the revision under § 543 Abs. 2 Satz 1 ZPO were plausibly demonstrated, satisfying the requirement under § 78b Abs. 1 ZPO that the action not be futile.

2 ZPO abgesehen.
