Sufficiency of DNA evidence presentation in criminal judgment; independent establishment of guilt through other indicia despite non-compliant genetic report
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (4th Criminal Senate) dismissed the defendant’s appeal as unfounded, upholding the Landgericht Münster’s conviction and ordering the defendant to bear the costs of the appeal and the necessary expenses of the ancillary claimant. The case involved a criminal prosecution for an assault, where the defense challenged the sufficiency of the evidence, specifically the presentation of molecular genetic comparative investigation results in the lower court’s judgment. While the Senate noted that the lower court failed to meet the specific requirements for describing DNA comparison results as established by BGH case law, it held that this procedural error did not affect the final outcome under § 337 Abs. 1 StPO, as the trial court had independently formed its conviction based on other incriminating indications.
