The Federal Court of Justice dismissed the appeals of the defendants as unfounded, leaving the judgment of the Hagen Regional Court dated August 17, 2021, in force, but modified the operative part for one defendant to clarify that a prior municipal court conviction from January 27, 2020, was already incorporated into a previous regional court judgment from November 3, 2020. The dispute concerned a criminal appeal where the lower court failed to explicitly state in the judgment's tenor that the sentence calculation accounted for this nested prior conviction, raising issues of correct sentencing calculation and the clear articulation of cumulative sentences. Relying on established doctrine regarding the requirements for stating the inclusion of prior judgments to prevent disadvantage to the defendant, the appellate court issued a clarifying order to amend the tenor to reflect the full chain of incorporated convictions, while also exercising its discretion not to impose the costs of the appellate proceedings on the appellants due to their youth or specific procedural context, though it ordered them to bear the necessary outlays incurred by the auxiliary victim in the appeal process.

Volltext
