Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (2nd Criminal Senate) dismissed the defendant's appeal as unfounded and upheld the lower court's conviction, ordering a clerical correction to the judgment's operative part to accurately list the offenses: providing narcotics to minors in 44 cases, robbery in two cases, robbery-extortion, dangerous bodily injury, and intentional bodily injury in five cases (one concurrently with deprivation of liberty). The dispute concerned a criminal appeal challenging the Landgericht Erfurt's judgment of November 22, 2021; while the appellate court found no further errors to the defendant's detriment based on the grounds for appeal, it determined that the original sentencing formula contained a technical inaccuracy regarding the classification of the bodily injury counts. The decisive legal basis involved the review of criminal sentences under German criminal procedure law, focusing on the admissibility of the appeal and the requirement for the operative part of a judgment to correspond precisely with the findings of fact, leading to the defendant bearing the costs of the appeal and the necessary expenses incurred by the auxiliary plaintiff.
