Rejection of non-admission complaint for lack of fundamental legal significance and uniform jurisprudence
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) rejected the plaintiff's motion to stay the proceedings and dismissed her complaint for non-admission of appeal, thereby leaving the lower court's decision in force; the plaintiff bears the costs of the appellate review. The dispute arose from a civil matter where the plaintiff challenged the appellate court's refusal to allow a revision appeal, arguing it met the statutory requirements for admission. The BGH ruled that the case lacked fundamental legal significance and that the development of law or the assurance of uniform jurisprudence did not require a decision by the revision court, citing established precedent and waiving a detailed written justification under Section 544(6) Sentence 2 Half-sentence 2 of the Code of Civil Procedure (ZPO).
