The Federal Court of Justice (BGH) dismissed the appeal for leave to file a complaint for non-admission (Nichtzulassungsbeschwerde), thereby upholding the Hamburg Regional Court’s July 14, 2020 order and leaving the lower court's decision in force. The dispute concerned a property management litigation involving the challenge of specific resolutions passed at a unit owners' assembly, including heating cost allocations and the discharge of the administrative board, where the appellant alleged errors in the trial court's value determination regarding which annual accounting periods (2014 vs. 2015) were affected by specific resolutions. The BGH rejected the appeal under § 543 Abs. 2 ZPO, finding that no question of fundamental legal significance arose and that no decision was required to develop the law or ensure uniform jurisprudence, while simultaneously correcting the appeal instance's subject matter value to €97,268.63 based on the specific heating cost amounts attributable to the plaintiff and a fixed €500 amount for the discharge resolution.

Volltext

Die Nichtzulassungsbeschwerde gegen den Beschluss des Landgerichts Hamburg - 18. Zivilkammer - vom 14.

Senat, Beschluss vom 9. März 2017 - V ZB 113/16, ZWE 2017, 332 Rn. 10 f.).
