Interest owed on remaining loan principal after withdrawal of distance consumer loan
Legislator-Zusammenfassung
KI-generiertThe plaintiff’s complaint against the non-admission of revision was dismissed, leaving the appellate decision in force and placing the procedural costs on the plaintiff. The dispute concerned the calculation of counterclaims following the withdrawal of a consumer loan agreement concluded at a distance (distance selling) in 2008, specifically challenging whether the borrower owed contractual interest on the loan principal remaining in their possession after the withdrawal became effective. The 11th Civil Senate of the Federal Court of Justice held that there was no need to refer questions to the Court of Justice of the European Union under Article 267(3) TFEU, as the CJEU had already clarified in the *Leonhard* judgment that the consumer owes payment for services actually rendered under Article 7(1) of Directive 2002/65/EC. The Court confirmed its consistent jurisprudence that, under the former Article 357(1) sentence 1 BGB in conjunction with Article 346(2) BGB, a borrower who withdraws a distance consumer loan agreement generally must pay a substitute value equal to the contractual interest for the loan principal that continues to be at their disposal post-withdrawal.
