The Federal Court of Justice (BGH) rejected the convicted defendant’s application for legal aid to cover the costs of the appellate criminal proceedings. The dispute arose after the defendant’s revision (appeal) was dismissed and the first-instance judgment from the Landgericht Oldenburg was largely upheld, with only a procedural supplement to the civil compensation (adhäsion) section; the defendant subsequently filed a belated request for cost assistance after receiving the final invoice. The court held that there is no statutory basis in German criminal procedure to grant general legal aid to accused or convicted persons regarding criminal trial costs, which are instead addressed through state-funded defense counsel; while cost assistance is available for separate civil compensation proceedings under § 404 Abs. 5 StPO, it requires a timely application and a showing of reasonable prospects of success. The court denied the request because the defendant failed to submit the required application and financial declaration before the conclusion of the proceedings, and retroactive relief under § 44 StPO was unavailable as the missing deadline was not a statutory time limit (*Frist*) subject to reinstatement.

BGH, Beschluss vom 18. März 2021 - 5 StR 222/20, juris Rn. 5 mwN).
