Liability of engine manufacturer for intentional statutory violation in vehicle emission case
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof dismissed the plaintiff's non-admission complaint, upholding the appellate court's decision to reject the plaintiff's claims, thereby leaving the lower court’s rejection of liability in force. The dispute concerned a damages action arising from alleged diesel emission cheating, where the plaintiff sought compensation from a defendant acting as an engine manufacturer. The court held that the complaint failed to demonstrate grounds for revision: regarding the tort claim under §§ 826, 31 BGB, no qualifying legal issue was identified; regarding the claim under § 823(2) BGB in conjunction with the EU Framework Regulation on vehicle safety, the plaintiff failed to demonstrate the decision's relevance and insufficiently alleged that the engine manufacturer participated in an intentional statutory violation by the vehicle manufacturer; and alleged violations of procedural fundamental rights were deemed unfounded. The plaintiff was ordered to bear the costs of the complaint proceedings, with a contested amount of up to €30,000.
