Tort liability of engine manufacturer for emissions regulations breach: insufficiency of participation in vehicle manufacturer’s intentional violation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's denial of a damages claim; consequently, the plaintiff did not prevail and must bear the costs of the proceedings. The dispute concerned a tort claim under § 823(2) German Civil Code in conjunction with emissions regulations, specifically challenging a lower court decision that dismissed liability for alleged emissions cheating in the automotive sector. The decisive legal basis for the rejection was the failure to demonstrate that the case involved questions of fundamental legal significance or the need for uniform case law, as the plaintiff inadequately substantiated that the defendant, acting as an engine manufacturer rather than a vehicle manufacturer, had participated in a deliberate legal violation by the vehicle manufacturer.
