Liability of motor manufacturers for vehicle emission violations under § 823(2) BGB and EG-FGV in light of non-participation in statutory breach
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the plaintiff's non-admission complaint, thereby upholding the appellate court's decision and leaving the dismissal of the plaintiff's claims in force. The dispute concerned a liability claim under tort law for alleged violations of motor vehicle emission regulations, specifically challenging the appellate court's refusal to grant damages based on the participation of a component manufacturer in a statutory breach by vehicle manufacturers. The court held that the complaint failed to demonstrate a matter of fundamental significance or the need for legal development, noting that the plaintiff did not sufficiently allege that the component manufacturer intentionally participated in the vehicle manufacturers' violations of § 6(1) and § 27(1) of the Emissions Goods Regulation (EG-FGV) in conjunction with § 823(2) BGB; alleged procedural fundamental rights violations were also deemed non-meritorious.
