Enforcement procedure: Inadmissibility of legal appeal against appellate decision where further appeal not admitted.
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the appeal as inadmissible, ruling in favor of the debtors and placing the costs on the appellant. The dispute concerned a procedural objection to a decision issued by the appellate court within a compulsory enforcement procedure, where the appellant challenged the lower court's failure to admit the further appeal. The court held that an appeal against a final appellate decision in enforcement matters is only permissible if expressly admitted by the lower court under § 574(1) sentence 1 no. 2 of the Code of Civil Procedure (ZPO), which did not occur here; the court further determined that the non-admission of the appeal is not subject to review via a complaint for non-admission, as the legislature explicitly excluded such recourse and no constitutional right to a second instance on admission exists.

BGH, Beschluss vom 23. September 2020 - I ZB 60/20, juris Rn. 3 mwN). BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133 [juris Rn. 7 f.]; Beschluss vom 19. Mai 2022 - I ZB 26/22, juris Rn. 3).
2. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
