Statutory competition between dangerous and grievous bodily harm in concurrence with attempted murder
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) rejected the defendant's appeal against the Hamburg Regional Court's judgment, upholding the conviction and ordering the defendant to bear the costs of the proceedings. The case involved a criminal appeal where the lower court had convicted the defendant of attempted murder in concurrence with grievous bodily harm and dangerous bodily harm, including a specific count where the court held that dangerous bodily harm via a dangerous tool was displaced by grievous bodily harm through statutory competition. In an obiter remark, the appellate court confirmed that this legal reasoning did not adversely affect the defendant, thereby validating the lower court's application of the doctrinal principle that § 224(1)(2) StGB (dangerous bodily harm) is absorbed by § 226(1) StGB (grievous bodily harm) in cases of legislative competition, while noting divergent recent case law on this point.
