Admissibility of non-admission complaint where appellate decision rests on independent findings of behavior change, causation, and fault
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of appeal, leaving the appellate court's decision in favor of the defendant in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil matter where the lower court had decided on grounds of changed behavior, causal link to acquisition, and fault, while the plaintiff attempted to challenge this based on fundamental legal significance and alleged violations of procedural fundamental rights. The BGH held that the complaint failed to demonstrate that the alleged legal questions were decisive, as the appellate decision was independently supported by the cited factual and legal considerations, and found no compelling violation of procedural rights, thereby denying revision under § 543 ZPO.
