Duty to disclose plea-bargain consultations under § 243(4) StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the appeals of the defendants, leaving the Landgericht Dresden's judgment of 20 April 2023 in force and ordering each appellant to bear their own costs. The case involved criminal appeals challenging procedural regularity, specifically alleging a violation of the presiding judge's duty to disclose "consultations" regarding plea bargains or the procedural consequences of the defendants' conduct during the main proceedings. The court held the procedural complaints unfounded, determining that the defendants failed to demonstrate that a conscious discussion between the judge and defense counsel regarding potential plea deals or procedural outcomes had actually taken place, thereby failing to meet the strict requirements for establishing a breach of the obligations under § 243(4) sentence 2 and § 257c of the Code of Criminal Procedure (StPO).

März 2013 – 2 BvR 2628/10, BVerfGE 133, 168 Rn. 85; BGH, Beschluss vom 24. Mai 2023 – 4 StR 493/22, JR 2023, 584).
